A’Court dismisses suit seeking to disqualify Akpata as Edo LP candidate

The Court of Appeal in Abuja recently ruled on a case aiming to disqualify the Labour Party candidate, Olumide Akpata, from the upcoming Edo State governorship election. The suit brought by Kenneth Imasuangbon was dismissed by the three-member panel, citing failure to exhaust the party’s internal conflict resolution process before resorting to legal action. The court emphasized the lack of substantial evidence against Akpata and deemed Imasuangbon’s claims as beyond its jurisdiction. Justice Okon Abang highlighted that the appellant failed to provide crucial evidence regarding the primary election results and criticized the absence of witnesses to support the case. The appellate court upheld the Federal High Court’s decision in Benin City, stating that Imasuangbon’s suit lacked merit. Imasuangbon’s plea to disqualify Akpata and replace him as the candidate based on alleged election irregularities was ultimately dismissed by the court.
