A judgment is pending in the legal challenge by the reinstated Speaker of the House of Assembly, Mudashiru Obasa, regarding the legality of the proceedings that led to his initial removal on January 13, 2025.
The judge will communicate the date for delivering the judgment and rulings after considering various preliminary objections from the defendants’ counsel.
Obasa’s counsel argued for the court’s jurisdiction, stating that the assembly’s session on January 13, 2025, was improper as it took place during a recess without proper notification to key officials.
In opposition, the Assembly’s counsel argued that the subsequent reelection of Obasa on March 3, 2025, superseded the earlier proceedings, contending that the House’s internal affairs are beyond the court’s interference.
Different arguments were presented by the defendants’ counsel, with one side claiming the January 13, 2025, proceedings were valid while the other side argued they violated the House’s rules, justifying court intervention.
The Assembly filed a preliminary objection, stating that Obasa’s suit lacked a required pre-action notice and that the House has the authority to appoint and remove its officials without court intervention.
With Obasa’s reelection and the restoration of other officials, the defendants argued that the case had become irrelevant and an abuse of the judicial process.
